What are "zip guns" and are they legal in Texas?

According to §46.01.(16) a zip gun is "a device or combination of devices that was not originally a firearm and is adapted to expel a projectile through a smooth-bore barrel by using the energy generated by an explosion or burning substance."

Under §46.05 of the Texas Penal Code it is a crime to intentionally or knowingly possess, manufacture, transport, repair or sell a zip gun. §46.05(a)(9).
